Keywords:
State Civil Apparatus, Dismissal, Administrative SanctionsAbstract
Civil Servants who commit corruption are not only subject to criminal sanctions but also administrative sanctions in the form of dishonorable dismissal. There are differences in the verdicts for the 2 cases carried out by Ikhwanuddin and Yasin Naue. This study uses a normative method by analyzing the doctrine and the judge's decision. The results of the study indicate that a Civil Servant must be given a permanent court decision if he is proven to have committed a crime of corruption, after which he is subject to administrative sanctions through a Decree issued by an Authorized Official. The difference in the verdicts for the two cases studied was caused by the difference in the officials who signed the Decree, in the first case it was the Acting Governor, while in the second case it was the definitive Governor.
