Abstract

The Commercial Court in Indonesia plays a crucial role in resolving bankruptcy disputes efficiently and promptly, in accordance with Law Number 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations (UUK-PKPU). The bankruptcy dispute resolution procedure begins with the submission of a petition by creditors or debtors, which must meet the requirement of having at least two creditors and debts that are due and unpaid. This process provides legal certainty for creditors, while the debtor's assets are managed by a curator to settle the debt obligations. However, the implementation of this procedure faces various challenges, including a lack of professionalism among curators, inconsistencies in legal application, and the potential misuse of bankruptcy procedures. Additionally, the success of debt restructuring alternatives through the Suspension of Debt Payment Obligations (PKPU) depends on the cooperation and goodwill of the parties involved. This study employs a normative research method to analyze the legal framework, practices, and challenges in the bankruptcy dispute resolution procedure in the Commercial Court. The findings highlight the need for strengthened regulations, improved transparency, and enhanced oversight of bankruptcy procedures to achieve justice and legal certainty. With these improvements, the bankruptcy system can support a more conducive business climate and ensure the protection of rights for all parties involved.
