Pandangan Hukum Islam terhadap Implementasi Penegakan Hukum Pemberantasan Korupsi di Indonesia

The aim of this study is to identify solutions to rampant corruption in Indonesia. The main objective of this study is to use Islamic legal theory to investigate the legal standards contained in laws related to law enforcement and eradicating corruption in Indonesia. This study uses a normative juridical approach, which considers law as a system that creates legal norms and includes analysis of ideas, conceptions, legal principles and regulations. The findings of this research indicate that legal standards in Indonesian legal regulations that aim to eliminate corruption only contain two components: al-murtashi and AR-Rashi. However, there are three components of Islamic law: ar-Rashi, al-murtashi, and ar-Ra'isy. The legal subsystem for eradicating corruption is very weak because there is no ar-Ra'isy (intermediary) component. Furthermore, Islamic law groups punishment into three types: the first is the law of ta'zir, which regulates physical punishment, including the death penalty and flogging; second, the ta'zir law regarding independence or personal freedom, namely imprisonment; and finally, ta'zir law regarding property, which includes compensation or fines, and confiscation. The concept of punishment in anti-corruption legislation is also limited to fines and prison sentences.
